EU: Etiket van voedingsmiddel mag consument niet misleiden
A German consumer-protection association complained that through the items on the packaging, the German company Teekanne that markets tea, misleads the consumer with regard to the tea’s contents. The Court of Justice reiterates that EU law requires that the consumer has correct, neutral and objective information that does not mislead him and that the labelling of food cannot mislead.
The Court makes clear that the list of ingredients, even though correct and comprehensive, may not be capable of correcting sufficiently the erroneous or misleading impression which the consumer gains from the labelling of the foodstuff (Persbericht Hof van Justitie van de EU, 4 juni 2015).
